My City Gets In The Act—Taking Away Their Workers’ Rights and Freedoms

I oppose your mandatory policy of requiring all your employees to be vaccinated in order to hold their jobs. 

This violates The Charter of Rights and Freedoms of the Constitution Act of 1982 that I helped craft. 

What you are doing violates Section 6 (2)(b) 

  • 6 (1) Every citizen of Canada has the right to enter, remain in and leave Canada.
  • Rights to move and gain livelihood
  • (2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right
    • (a) to move to and take up residence in any province; and
    • (b) to pursue the gaining of a livelihood in any province.

Additionally , you are violating Section 7–‘ every citizen has a right to ‘life , liberty and security of the person’ and Section 15–the right ‘ to equality before the law. ‘

No doubt you have been told by your lawyers and/or Provincial Government lawyers that this is all proper and within the Charter. 

They are wrong !

It is likely that The Province has advised you that you are protected because of Section 1 of the Charter . You are not.

Section 1 is meant to be used when the state is in peril, war, insurrection. A virus with a 99% recovery rate and a fatality rate of 0.08% hardly qualifies as a peril to the state. 

And if , for arguments sake , Section 1 did apply no Government has met the tests necessary in order for this section to qualify:

  1. Demonstrably justify
  2. By law
  3. Reasonable limits 
  4. Consistent with a free and democratic society

For example , to just take two of these tests ,numbers one and four. 

To demonstrably justify would mean a cost benefit analysis  . None has been done by Governments. Numerous Independent studies show that the cure is worse that the disease : The Great Barrington Declaration and a study by Dr. Douglas Allen of Simon Fraser University involving 80 studies  , both now over a year old and still valid . Hundreds more exist that I can send you. 

To be consistent with a free and democratic society would mean meaningfully involving the Parliaments of this nation, parliaments being open, parliamentary committees studying the Government measures and making recommendations. And how about involving the people directly; there has been lots of time to do this. That would be a free and democratic society. 

So , you are violating the Supreme Law of this Country , our Constitution . Section 52 of the Constitution states

 ‘52 (1) The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect.’

Additionally, you  may have been advised that the courts have ruled . Some lower courts have ruled, but the Courts of Appeal and the Supreme Court of Canada have not yet ruled and appeals are underway. The game is not over. 

Lastly , the first words of the Charter of Rights and Freedoms states : ‘Whereas Canada is founded upon principles that recognize the supremacy of God and the rule of law:’

The lower courts ‘ decisions to date have not acknowledged that these are the principles that must guide all decisions made using the Charter and hence are invalid decisions. 

I am prepared to make a presentation to Council and answer any questions. 

Daily , now , major organizations are beginning to walk back their earlier support of these covid measures, including the World Health Organization, media outlets and researchers. Government narratives are falling apart as vaccines don’t work as advertised, tests are flawed, masks don’t work and these covid vaccines have killed and injured more people than all other vaccines together over the past 30 years.  

You are travelling in the wrong direction of fact ,  the Constitution and history.

Please reconsider and protect the rights and freedoms of your employees.

    Can we send the same to Nanaimo and all others on the Island or even BC? I always found one of the best ways to get a response in business is to send the same message (say email) to a handful of people (all in the To line). Invariably at least one would feel compelled to act as they were concerned someone would otherwise start interfering in their realm and they didn’t want things getting away from them. In contrast, if only one receives it, they tuck it away until they have time (never).

    Is it time to withhold taxes proportional to the suspension of services which we are forbidden to use? Pools, gyms, concert venues which are supported through taxes might be 10-20 % of what I use in the CVRD. Airports and travel infrastructure are federal programmes, I don’t need to pay for provincial restaurant and liquor inspectors if I am banned from those services. This would have to be organised through Action4Canada or a similar group to avoid individual targeting by governments, but I am trying to think of something nonviolent which could drag them into court where they would have to defend and explain their actions.

    • In principle this makes good sense, speaking reason to dictatorship. But they are not likely to go along with a hollowing out of their system. Perhaps a parallel society approach, of not using the vax only services, is a way out in the short and long term? Pam Popper describes how her groups were able to do this last year in the US. Above all, the system, now tyrannical wants legitimacy. Ignoring the the system and working outside of it is not what they have planned for. They assume people are trapped within their smartphones and Costco’s.

  5. The fully vaccinated can get and transmit covid-19. The vaccinated are have zero immunity against Covid-19, even with the booster. This is the same for an unvaccinated person. The vaccine benefit is moderation of Covid-19 symptoms reportedly leading to fewer hospitalization, and deaths. The unvaccinated do not get this moderation benefit. That is the only difference.
    Imposing a vaccination mandate in a work environment has no scientific benefit. It will not stop the spread of Covid-19 because Covid-19 make no distinction between fully vaccinated and unvaccinated.

    In addition the imposition of a work place vaccination mandate with an experimental drug is in violation of the Nuremberg Code, Declaration of Helsinki and Medical Ethics that states

    The Nuremberg Code was established after World War II to ensure that informed consent was built into any medical experimentation on human subjects:

    The voluntary consent of the human subject is absolutely essential.
    This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved, as to enable him to make an understanding and enlightened decision.

  6. For Shame to the Mayor & City Council of Parksville or another Canadian municipality culpable in the ‘jab or job’ mandate — so WRONG!

    “Your Rights. The Nuremberg Code, the UN Declaration of Human Rights and the UNESCO Universal Declaration on Bioethics and Human Rights are agreements that give citizens the right to choose to consent to any biological intervention after being fully informed about the intention, risks and benefits of the procedure, and being free from coercion in any form to consent.” Moreover, along with the full disclosure by the manufacturer of the ‘medication’ as to the benefits, risks, the attending physician, in good professional conscience, is to also provide the viable alternatives or options available in lieu of the ‘medication.’

  7. If you are right about the Charter, and I have to assume that you are, why is this not being litigated? Does the Charter not have any practical legal force? Are there no lawyers interested in testing its application? Are there no judges willing to hear such cases?
    I am honestly baffled here, help me out. I want to believe that we have legal rights in Canada, but it doesn’t seem to be the case when governments can regulate people’s lives like they are right now.

  8. As this is totally unconstitutional I would urge all fired employees to sue city councillors not the city. They have not done their due diligence and are liable for any harm as it is not constitutional. Name them all and not the city stick together as a small class action. They will fold then sue for punitive damage. We are not done yet.
