Canadian Democracy In Crisis: So , Who Thinks The Governments of Canada Want To Get To The Bottom Of The Necessity and Constitutionality Of Their Covid Measures ? That’s Why An Independent Citizen’s Inquiry Is So Crucial. 

Last fall I indicated that all the Premiers and the Prime Minister of Canada had  a mechanism at their disposal to test the Constitutionality of their harsh Covid measures. It is called the reference procedure.  After all, it was these leaders who were assuring the public that all the measures they were enacting were legal , were constitutional. 

So I wrote the 10 Premiers and the Prime Minister asking if they would refer their measures to their highest court ( as is  provided in existing legislation) to ask if their measures were indeed constitutional.

Well, wouldn’t you know not one Premier or the Prime Minister agreed to follow this procedure. Most never even answered and when they did it was a perfunctory , electronic acknowledgement. 

Except one . My native Province , Newfoundland and Labrador. The Government, through their Minister of Justice of that Province,  informed me that their answer was they could not give me an answer.. Their reason for the non answer was because of the client/lawyer relationship. You know the Minister of Justice being the lawyer of the Ministry of Health . Here is a part of that reply dated October 14, 2021 :

‘As you can appreciate, given your correspondence relates to the constitutionality of measures undertaken by the Government of Newfoundland and Labrador in response to the severe acute respiratory syndrome coronavirus 2/COVID-19 pandemic, we are not in a position to offer any specific response, as advice provided by the Department of Justice and Public Safety to client departments on these matters is subject to solicitor-client privilege and is therefore confidential.’

So on this inquiry of mine no Premier or the Prime Minister was the least bit concerned about the constitutionality of their measures . They had all the answers and hence there was no need to test what they were doing. Or they were afraid to test their measures . 

Well, fast forward a few months to April 2022 . 

I initiated another question to all 14 First Ministers , including now the first ministers of the three territories. This question was whether they would support an independent National Inquiry to determine whether the pandemic measures were necessary and constitutional. That it would involve qualified people outside the Government. 

One again the silence was deafening . All answers received , about half of the First Ministers responded with just an electronic acknowledgement .

Except one. This time the Government of New Brunswick. Their answer was that they were doing their own  review through the Auditor General. That is, an officer of the Legislature would review the actions of the Government and the Legislature. The legislators examining themselves. Here is part of that response dated May 6, 2022. 

‘To That end , the Auditor General of New Brunswick will conduct a review of the province’s management of the CVID-19 during the pandemic and will report its findings to the Legislative Assembly. I am sure you will agree that this is the most appropriate course of action that any government may take in these circumstances.’

This represents starkly the state of our democracy . 

Most Governments don’t even respond to an important question of public policy and the ones that do , it is an electronic reply . So much for accountability !

And the two leaders that did respond in any detail , one invokes a client lawyer relationship to deny the public Government’s reasoning  for not testing the constitutionality of a Government measure , and the other to have an officer of the Legislature examine its own actions, not to mention the lack of expertise of the Auditor General on constitutional and medical matters . 

The idea of a National Inquiry led by independent citizens takes on added credibility and necessity when one examines this evidence. 

To think that Governments , now so far into a false narrative , will suddenly see the error of their ways , is refuted by these  experiences of mine.

    PHILOSOPHICAL DOCTRINES that obligate placing the needs of others above those of your own (i.e. altruism) as a moral imperative (which is a distinct category from respecting the individual rights of all others, likewise having a care for some others) ultimately results in policy (the use of govt force) to extract our sacrifices for the “greater good” (the welfare state).

  2. Honorable Brian Peckford – I think the reason you pretty much get ignored by any and all provincial governments across Canada is because you scare the hell out of them. They just don’t know how to reply to you – the last living person to sign the Charter and so have faultless, intimate knowledge of it’s definitions, purpose and importance so they either ignore you or give you a non answer because they really don’t know anything about the Charter. They deep down know they are wrong and have illegally bullied Canadians the past two years. They all just want you to go away. But keep harassing them as you are the only qualified one on the right side of history in this matter and your attempts at freeing all Canadians from this tyranny will go down in history. Go get them sir !!!!!!!!!!

  3. I am disheartened that Canadians so willing give away *everything* that our ancestors gained for them (via their blood, sweat, tears, and there very lives in war).

    God will punish this country as a whole if it doesn’t upload truth and Justice and human rights.

    The constitution (as you know) is the only sacred covenant from the people to their leaders, that prevents tyranny and war, like humanity experienced most recently in WW2.
    I Pray now for Canada and ask that you join us for the sake of your own future and the dim futures of all the children at present🙏❤️🕯

    In the event I am ever charged with a crime, I will demand to be allowed to investigate myself. After all, our governments have set the precedent.

  5. Reading the response to you from NFLD it reminds me of what seems to have happened in the medical sector. And it’s along these lines: once we allowed a few people to die following the protocol, we can’t very well reverse course now. Because that would implicate us even though we didn’t order the crime to be carried out. The concept of emergency, (with many empty hospitals in 2020) prompted the less aware, the less ethical to follow along much like the Germans did in the1930’s. Covert and not so covert threats were made to the domestic population then, as now.

  6. Of course the Premiers don’t support such an inquiry because they are all guilty! The public must remain oblivious to the damages caused, and kept oblivious at all costs. I do cry for Canada, for Premier Peckford, for the many for have been jailed and fined, and vilified, and lost jobs and friends and family members for speaking up. But let our tears only strengthen our resolve to press on in our fight for TRUTH, and against injustice. May we not be silenced and may we not give up.

The real reason why the BNA Act was repatriated and replaced with the constitution act and charter of rights and freedoms is so that like the its American equivalent it could be used as a political fig leaf when needed and also ignored or even fiddled with when needed. This preamble that Canada is based on the supremacy of God and the rule of law is a miracle that is hard to explain. Given the nature of Canada’s leaders it is surprising it was included. It is also not surprising that it is ignored in favor of political correctness. Canada is not ready for self government and it has too much law and government for its own good. Damned near everything has become either too expensive or too illegal on one hand or vice is protected as if it were a virtue. This is not a good thing.

    • Perhaps complexity in this issue (governance) is reflective of so much complexity in our world. We have subdivided ourselves into more and more specialties, with the promise from the WEF types that more technological change is set to come. The concept of Socialism is that society will be run by experts, which means that no individual shares anything in common with anyone else. It’s all a farce of course, we the people can understand and manage our world properly, but we’ve been trained not to.

  9. Canada is structurally designed to allow totalitarianism with no real checks and balances on executive power. Past governments have never acted out in this manner only through basic decency and the counterbalance of a semi-independent media. Now that we have a PMO with no moral constraints, an overwhelming desire for absolute power and control, and a paid-for media, the true nature of the Canadian system is being revealed. Outside of mass protests or a military backed insurrection there isn’t a damn thing any of us can do about it. I sure appreciate you trying Brian but I don’t think for a moment they will ever give you a response.

    • Although I agree with the substance of your point, that Canada is an ex- colony still looking for direction from larger powers. The PM certainly acts that way. The way Mulroney quite quickly tried to devolve Canada into part of the US was met with quite a bit of public resistance back in 1988, which then was backed up to some degree by the Senate. That forced a national election on the US Canada Free Trade deal, where every corporation as well as Maggie Thatcher tried to influence the vote. They succeeded, globalism won. However to some small degree, the Senate also recently rapped the PM’s knuckles if I remember correctly, or they were about to over the Emergency Powers. The truckers made their point, and many people got it. So, there is some history in Canada of people having an ability to push back, however pathetic it might seem. We do need more politicians to resign en masse, and perhaps prop up the PPC to signal that all is not well in “the worlds first post national country” as the PM called us.

      We are being directed into a permanent Lockdown along with Australia and NZ, the system is covertly declaring war against the people, and Canada historically at least, won wars. The politicians have almost no options other than to grow up, smell the coffee etc. The digital ID system is the end of any semblance of human freedom and they haven’t got a clue.

      Not legally any way. Creating the right sort of political party and getting a majority government might do it but it would take a miracle.
